The Terms and Conditions of Booking


Mode of Payment

The balance of the full amount of the trip is to be made according to one of the following ways . Only one of them fulfilling the booking will be considered valid for all purposes :

A) BANK TRANSFER - By bank transfer , by sending e-mail or fax a copy of accreditation (Fax : +39.0421.211010 )
B) CREDIT CARD - Credit card by fax or by phone . For this method you will need the following information: credit card number, card type ( Visa , Mastercard ... ) , expiration date , name and surname of the card, consent to withdraw the total amount of the trip.

Given that: a) the legislative decree n. 111 of 17.3.95 implementation of Directive 90/314/EEC provides for the protection of the consumer that the organizer and the seller of the package, the consumer is directed , must be in possession of the administrative authorization to carry out their activities (Article 3/1 lett d. lgs. 111/95 ) . b) the consumer has the right to receive a copy of the contract of sale of the tourist package ( pursuant to art. 6 d. lgs. 111/95 ) , which is essential to apply for the Guarantee Fund referred to in Article . 18 of these General Terms and Conditions . The notion of a " package" (Art. 2/1 Leg. 111/95 ) is as follows : tourist packages are subject to travel , holidays and "all inclusive " , resulting from the combination of at least two of the following when sold or offered for sale at an inclusive price , and lasting more than 24 hours or extenders for a period of time including at least one night: a ) transport b ) accommodation c ) tourist services not ancillary to transport or accommodation (omitted) that constitute a significant part of the "package ."


The contract for the sale of the package, is governed not only by these general conditions , by the clauses indicated in the travel documents handed to the consumer . This contract, whose object is to provide services in Italy and abroad , will also be governed by the provisions - as applicable - Law 27/12/1977 n ° 1084, ratification and implementation of the International Convention on Travel Contracts (CCV ) signed in Brussels on 23.4.1970 , as well as the aforementioned Legislative Decree 111/95 .


The organization has an obligation to carry out the program in the catalog or a catalog sheet. The elements that must be included in the technical catalog or brochure program are: the administrative authorization of the organization; extreme civil liability insurance policy , the period of validity of the catalog or brochure program ; reference exchange rate for the purposes of currency adjustments , day or value.


The reservation must be made on the appropriate contractual form , if electronic , filled in all its parts, which will be generated by the respective voucher. The acceptance of a reservation is considered complete , with subsequent conclusion of the contract, only when the customer receives documentation Travel / voucher also through the electronic system. Indications regarding the package not contained in the contractual documents , brochures or other means of written communication will be provided by the organizer in fulfillment of obligations under the Decree at their own expense . The extent of up to a maximum of 25% of the price of the package , to be paid at the time of booking or on request demanding and the balance 30 days arrange before the date of departure. The customer who withdraws from the contract before departure outside of the cases listed in the preceding paragraphs of this Article, All'Orologio Hotel will charge a penalty , the following percentages of the total cost of travel, excluding any taxes and insurance policies . 25% penalty up to 30 days before departure, 80 % of the Penal 29-15 days prior to departure and penalty of 100% from 14 days to the day of departure. Participants must have their own passport or other valid document. They must also follow the rules and information provided by the organizer , as well as regulations and administrative or legislative provisions relating to the package . Participants will be liable for all damages that the organizer may suffer as a result of their failure to fulfill obligations discussed above . The consumer must provide the organizer with all the documents , information and evidence in its possession relevant to the exercise of the right of subrogation against third parties responsible for the damage and is responsible to the organizer of the injury caused to the right of subrogation. The consumer shall inform the organizer in writing , at the time of booking, special personal requests that may be the subject of specific agreements on travel arrangements, provided that it is possible to implement.


The official classification of hotels is provided in the relevant informative material only on the basis of explicit and formal indications by the competent authority of the country in which the service is provided. In the absence of official recognized classification of the competent Public Authorities of the countries members of the EU where the service is provided, the organizer reserves the facoltè provide brochures in his own description of the accommodation, such as to permit an evaluation and subsequent acceptance of it by the consumer .


The organizer is liable for damages caused to the consumer due to the total or partial performance of the contract , whether these are performed by him or by third party service providers , unless he proves that the event was caused by the fact the consumer ( including initiatives undertaken by the latter in the course of the tourist services ) or by circumstances beyond the provision of services under the contract , by accident , force majeure or circumstances that the organizer could not according to the professional diligence reasonably foresee or resolve. The vendor from whom the booking has been made of the tour package is not liable in any way for the obligations arising from the organization of the trip, but is responsible exclusively for the obligations arising from his role as intermediary or otherwise to the extent that liability under the laws or conventions mentioned above.


The organizer is obliged to lend assistance to the consumer imposed by the professional standard of care exclusively to refer to the obligations at its own expense required by law or contract. The organizer and the seller are exempt from their responsibilities ( art. 13 ), when the failure or improper performance of the contract is attributable to the consumer or is dependent on a third party to unforeseeable or unavoidable, or by a fortuitous event of force greater .

Any failure in the contract must be contested by the consumer without delay so that the organizer you promptly to remedy . Consumers may also file a complaint by sending a registered letter with acknowledgment of receipt to the organizer no later than 10 working days from the date of return .


Is set up within the Directorate General for Tourism of the Ministry of Productive Activities , the Guarantee Fund to which consumers may apply ( pursuant to art. 21st Leg. 111/95 ) , in the event of insolvency or bankruptcy of the seller or organizer for the protection of the following requirements: a ) refund the price paid , b ) repatriation in case of travel abroad. The fund must also ensure immediate availability of funds in case of forced return of tourists from non-EU countries on the occasion of whether or not due to the organizer . The mode of operation of the Fund are established by decree of the President of the Council of Ministers of 23/07/99 , OJ 349 n . 249 of 10/12/99 ( in accordance with Article 21 n . 5 D. lgs. N . 111/95 ) .



The contracts for the supply of the only transport service , stays , or any other separate tourist service can not be configured as a case in point of travel or tourist package , are governed by the following provisions of the CCV : art. 1 , n . 3 and n . 6 , art. 17 to 23 ; art . from 24 to 31, with regard to provisions other than those relating to the contract for the organization as well as other agreements concerning the sale of a single service contract .


These contracts are also subject to the following clauses of the general conditions of contract packages above : art. 4 paragraph 1 , art. 5 , art. 7; art. 8 , art. 9 , art. 10 paragraph 1 , art. 11 , art. 15 . The application of these clauses does not determine the configuration of the contracts with the case of package tour. The terminology of the cited provisions relating to the tourist package contract (organizer, travel , etc. . ) Can be understood with reference to the corresponding figures of the contract of sale of individual tourist services (seller , living room, etc. . ) .
